Entry Requirements

Candidates should—

(a) (i) be solicitors with at least 6 years’ professional experience since admission in Hong Kong or any one of the recognised jurisdictions as stipulated under section 2A of and Schedule 2 to the Legal Officers Ordinance (Cap. 87); or (ii) be barristers with at least 7 years’ professional experience since attaining the right to full practice in Hong Kong or any one of the recognised jurisdictions as stipulated under section 2A of and Schedule 2 to the Legal Officers Ordinance (Cap. 87); and

(b) have attained Level 2 or above in English Language and Chinese Language in the Hong Kong Diploma of Secondary Education Examination (HKDSEE) or the Hong Kong Certificate of Education Examination (HKCEE), or equivalent (Note: For non-civil service appointment purpose, Grade E in English Language (Syllabus B) and Chinese Language in the HKCEE before 2007 are accepted administratively as comparable to Level 2 in English Language and Chinese Language in HKCEE in or after 2007.).

Notes: (i) Candidates with experience in legal drafting will have an advantage; and (ii) Candidates with less working experience (a minimum of 4 years’ professional experience for solicitors or 5 years’ professional experience for barristers) may also apply. If selected, they will be offered a salary at an appropriate level lower than HK$117,580 per month for full time employment or HK$693 per hour for part-time employment.

Duties

To draft Government legislation in Chinese and/or English, to provide incidental legal advisory services to the Government Secretariat and various departments, to attend internal and external meetings and answer questions on legislation, to assist in the preparation of various papers required in the legislative process, and to perform any other duties that may be assigned from time to time or deployed to other offices of the Department to undertake any other legal work. The holder of post (1) is expected to assume a higher level of responsibilities and be able to work independently, and will be required to handle the drafting of more complex legislation.

Terms of Appointment

Successful candidates will be appointed on non-civil service contract terms for around 12 months. Renewal of contract will be subject to the service need of the Department of Justice and the appointee’s performance. \r\n\r\nSuccessful candidates will be required to, for full time employment, work for 44 hours per week and, for part-time employment, work for not less than 22 hours and up to 32 hours per week, during the contract period with regular or irregular working hours, depending on the operational needs. The successful candidates, whether on full time or part-time employment, must not undertake outside work during the contract period without this Department’s approval. \r\n

Salary and Fringe Benefits

HK$117,580 per month for full time employment or HK$693 per hour for part-time employment
For full time employment, the appointee will be entitled to paid annual leave of 14 days per year of service; paid sick leave in accordance with the provisions of the contract; and maternity/paternity leave, where appropriate. For part-time employment, the appointee will be entitled to paid annual leave of 7 days per year of service and paid sick leave in accordance with the provisions of the contract; and maternity/paternity leave, where appropriate.

Gratuity: For full time employment only: upon satisfactory completion of the contract, the appointee will be eligible for an end-of-contract gratuity which, when added together with the Government’s contribution to the Mandatory Provident Fund Scheme, will be equal to 15% of the total basic salary drawn during the contract period.

(a) Candidates must be permanent residents of the Hong Kong Special Administrative Region at the time of appointment unless specified otherwise.
